Regulations for the provision of services



I. General provisions.


Regulations mean the Regulations for the provision of an Internet service in the form of:         

  • placing a presentation         

  • posting a website         

  • maintaining e-mail accounts         

  • registration of the subdomain     

 

on the www.carehomescentre.co.uk internet portal         

 

  • The service provider is Point Group Marek Gabański, the leading internet portal www.carehomescentre.co.uk, based in Warsaw.         

  • The client within the meaning of the Regulations is the entity ordering the Point Group to provide an internet service in point 1 by completing the electronic order form, available on the above website or sending an order by post or by fax.         

  • Placing an order is tantamount to concluding a contract between the Customer and the Point Group company for the provision of an Internet service on the terms set out in the Regulations for the duration of the subscription period.         

  • By concluding a contract based on the provisions of the Regulations, the Customer declares that he has read and accepts the Regulations in its entirety.         

  • By accepting these Regulations, the Customer agrees to receive commercial information regarding Point Group's products and services.        

  •  Point Group reserves the right to amend the Regulations. These changes are valid from the moment the new version of the Regulations is made available at www.carehomescentre.co.uk. In the event of changes in the Regulations, the Customer has the right to raise objections within 14 days from the publication of the new version of the Regulations at www.carehomescentre.co.uk, on the terms set out in art. VII of the Regulations.         

  • In the event of opposition, Point Group has the right to:             

    • treating the opposition as an offer of early termination of the contract and accepting it with the reimbursement of fees in proportion to the unused benefits,            

    •  reject the offer and maintain the internet service on the current rules until the end of the current subscription period         

  • "Subscription period" is the maximum period of time for providing an Internet service in the Care Homes portal.         

  • "Accessibility of the service" - the visibility of the Internet service in the Care Homes portal. The availability guarantee applies to all offered services. Service availability also includes system maintenance breaks.

 

II. Customer panel        

 

  •  In order to order and manage the services provided by Point Group, it is necessary for the Customer to set up an account in the IT system, hereinafter referred to as the Customer Panel.         

  • The Customer, by creating an account in the Customer Panel, provides a login which is his e-mail address as well password.         

  • The Customer is obliged not to disclose data used to log in to the Customer Panel to third parties and is liable for any consequences of disclosure of such data.         

  • Point Group undertakes to take all technically possible and reasonable steps to protect the data collected in the Customer Panel against access and interference of third parties, as well as against unauthorized use of the Customer Panel.         

  • If the Customer violates the provisions of the Regulations in force at the Point Group and in particular when using the services for illegal activities, decency or infringing the rights of third parties, Point Group may block services or suspend access to the account in the Customer Panel.         

  • Point Group reserves the right to delete the account in the Customer Panel in which there has been no active service for the last 3 months.

 

II. Personal data         

 

  • The customer is obliged to provide true and complete data of the account creation subset         in the Customer Panel. If it is found that the data provided by the Customer is not true or complete, Point Group has the right to delete the account in the Customer Panel along with the services ordered with its use and terminate all customer service agreements related to the services ordered under this account. Before terminating the contracts, the Point Group will call the Customer to correct or supplement the data by sending a relevant request to the e-mail address provided in the Customer Panel.         

  • Point Group has the right to process the Customer's personal data necessary to provide services. Providing personal data indicated in the form when creating an account in the Customer Panel is voluntary.         

  • The customer has the right to inspect their personal data and correct them using the Customer Panel and to submit a request to delete their data, if they were collected in violation of the provisions or are already for the purpose for which they were collected.         

  • Point Group has the right, in order to perform the service and to the extent necessary for its implementation, to provide personal data of the Customer of the Foundation www.domyopieki.pl with its registered office in Warsaw, ul. Chlewińska 13         

  • The processing of personal customer data is voluntary, but it may be necessary to perform the service or electronic payment.         

  • In the case of Customers who are natural persons and who are Consumers, the Point Group has the right to request a copy of the document confirming the Client's identity and Kliet is obliged to provide the Point Group with a copy of this document within 7 days. A copy of the document confirming the identity should allow reading the name, PESEL registration number or other registration number, series and number of the document confirming the identity and address of residence. Before the delivery of the aforementioned copy the customer is obliged to blur all other data on the provided document, in particular: the image, family name, parents' names, place of birth, eye color and height. In the case of providing a copy of the document without prior deletion of unnecessary data, the Client declares that he agrees to the processing of data that has been made available to the Point Group.         

  • In the case of Clients who are not Consumers, Point Group has the right to request documents proving business activity or other documents proving the legal status of the Customer and the Customer is obliged to provide Point Group these documents within 7 days.         

  • The Customer, accepting the Regulations, declares that he has been informed about the purpose, scope of collection and  data processing by the Point Group and the www.domyopieki.pl Foundation, the right to inspect their data and correct them, the right to request the cessation of data processing and object to the processing of data resulting from the Personal Data Protection Act.

 

IV. Privacy protection.    

 

  • The administrator of the Customer's personal data is Point Group Marek Gabański, ul. Chlewińska 13, 01-695 Warsaw     

  • Personal data provided by the customer are processed for the purposes of the contract, order and with separate consent may be processed for marketing and promotional purposes.

  • Customer's personal data will be processed in the scope indicated in the order form.     

  • Providing personal data by the Customer is voluntary but necessary for the implementation of the contract.     

  • The customer has the right to access their data and correct them, request to stop processing them, object to their processing and demand their removal.     

  • The customer may receive by e-mail, in particular on the e-mail address provided by the customer, marketing or promotional materials, if he agrees.    

  •  The customer may at any time withdraw consent to receive marketing or promotional materials sent electronically by sending information about the cancellation to the following e-mail address: biuro@pointgroup.pl

 

 

V. Ordering an Internet service.         

 

  • Point Group undertakes to activate the online service by completing the electronic order form, available on the above website or sending the order by letter or fax and issuing a pro forma invoice as maintenance title.        

  •  The VAT invoice will be issued and sent by mail to the Customer within 7 days from the payment being recorded on the Service Provider's account.         

  • No payment on the Service Provider's account for the internet service within 14 days from the date of ordering the service results in blocking access to the service on the 15th day from the date of order for the next 7 days. If during this time the Point Group records the payment to the account for maintaining the Internet service, access to it will be unblocked, and the subscription extended for the subscription period indicated in the electronic order form, counted from the date of service order with the reservation specified in art. II of the Regulations.        

  •  The unpaid internet service within 14 days from the date of the order will be removed along with the additional services ordered for this internet service. The order will be canceled, about which Point Group will inform the Customer via e-mail or telephone. Canceling an order is tantamount to terminating the contract.

 

VI. Extending the period of providing an internet service.         

 

  • 14 days before the end of the current subscription period Point Group will send a pro forma invoice to maintain the internet service for the next subscription period.        

  •  The client makes the extension of the subscription period by making a payment to the bank account indicated by the Point Group, based on the sent pro forma invoice, the title of maintaining the service, for the next subscription period.        

  • The customer is obliged to make a payment for the next subscription period at the latest on the last day of the subscription period of the previous subscription period of the internet service.         

  • By making a payment for maintaining the service for the next subscription period, the Customer declares that he has read and accepts the terms of the current Regulations, price list and service specifications available at www.domyopieki.pl and thus concludes an Internet service contract in the next subscription period. Approved conditions are the only applicable at which Point Group provides the service.        

  •  After recording the payment on the Point Group account, for the maintenance of the service for the next subscription period, the service will be extended by another subscription period counted from the end of the previous subscription period. The VAT invoice will be issued within 7 days from the date of the payment on the Point Group account.         

  • Lack of payment on the Point Group account for maintaining the Internet service for the next subscription period up to the last day of the subscription period will mean blocking access to it, starting from the day after the end of the subscription period.        

  •  If, within 14 days of the end of the previous subscription period, the Point Group records the payment on account for maintaining the service for the next subscription period, access to the service will be unblocked and the service maintenance time extended for a further subscription period from the end of the previous period.        

  •  The lack of payment on the Point Group account as the maintenance of the Internet service for the next subscription period until the 14th day after the end of the previous subscription period will mean the termination of the agreement with Point Group and removal of the service from the Internet portal.

 

VII. payments         

 

  • The fee for the internet service is determined according to the price list located on the portal page, in effect on the day of ordering the service or on the day of commencement of the next subscription period. The subscription fee is indivisible.        

  •  The payment for the internet service is settled in the subscription periods.         

  • Point Group reserves the right to change the prices of the service. New prices are given in the updated price list available on the portal site and are valid from the day the change was introduced. Changing the price of the Internet service during the current subscription does not entail additional costs for the customer until the end of the subscription period paid for the service, or in accordance with the concluded individual contract.         

  • The customer is obliged to make a payment for the payment of the service to the bank account indicated by Point Group        

  •  A VAT invoice for maintaining the service is issued in accordance with the data provided by the Customer.         

  • In the case of payments for services at Point Group, the Customer's and Beneficiary's (Point Group) bank costs are covered by the Principal.         

  • Refunds will be transferred to the customer's bank account number in Poland.

 

VIII. Duties and responsibilities of the client.    

     

  • The customer is obliged to inform Point Group of any changes affecting the implementation of the contract.         

  • The customer is obliged to provide real data in the process of ordering the service.        

  •  The customer is fully responsible for the materials and content posted on his website and presentation, and in particular for the copyrights of the materials posted there.         

  • The customer is obliged to make payments on time.         

  • Point Group has the right to immediately cease providing services to a given customer, without the right to return the unused subscription amount, if the Customer breaks the provisions of the contract. IX. Duties and responsibilities of the Point Group.         

  • Point Group is committed to providing the Internet service to the full extent and with due diligence, is not responsible for non-performance or incorrect performance of the service due to reasons attributable to other entities.        

  •  The Point Group company reserves the right to make possible short technical breaks in the operation of the Internet service related to the operation and maintenance of the system.         

  • The Point Group company guarantees the availability of the service during the subscription period at the level of 99.9% per annum.         

  • Point Group is not responsible for any damage caused, among others, as a result:            

    •  lack of continuity of service provision caused by actions or omissions of third parties             

    • natural disasters,             

    • breach of the contract by the Customer.         

  • Point Group is not responsible for the materials and content posted on the websites and presentations of customers, and in particular to the copyright of the materials contained therein.         

  • In each case, the liability of the Point Group is limited to the value of the payment made by the Customer.

 

X. Complaint procedure.         

 

  • Customer complaints in connection with non-performance or improper performance of services should be sent Point Group in writing to the correspondence address Point Group and specify:             

    • Customer data enabling contact with him and identification as a Point Group Customer,            

    •  the type of service concerned,             

    • customer complaints,             

    • circumstances justifying the complaint,             

    • any possible way to remove the alleged mistake         

  • Point Group undertakes to provide a written response to the complaint, within 7 days from the date of its receipt by indicating - whether it accepts complaints, how to solve the problem, information or complaint is justified XI. Final Provisions.        

  • The Polish law applies to the contract between the Customer and the Point Group. The parties are obliged to comply with the law currently in force in Poland.         

  • Any disputes that may arise from the contract between the Customer and the Point Group, which can not be prevented by a complaint procedure, will be resolved by a common court competent for the Point Group headquarters.         

  • Point Group reserves the right to terminate the contract in the event of the Customer breaking the contractual provisions.        

  • The Regulations are valid from October 17, 2007.
